ARTICLE 1 - Scope

These General Terms and Conditions of Use (referred to as "GTC") apply, without restriction or reservation, to all use of the SPOTLIGHT application and services by users ("The Users or the User"). SPOTLIGHT is a fitness tracking application designed to help users log, track, and analyze their workout sessions and exercise history.

The main features of the Service include workout tracking, exercise history, performance analytics, and personalized fitness data management.

These GTC are accessible at any time on the SPOTLIGHT application and shall prevail over any other document. The User declares to have read these GTC and accepted them upon creating an account or using the Service.

ARTICLE 2 - Access to the Service

The SPOTLIGHT application is accessible free of charge to any User with internet access. All costs related to accessing the Service, whether hardware, software, or internet access costs, are the sole responsibility of the User.

The Service may occasionally be interrupted for maintenance, updates, or technical reasons. The Provider shall not be held liable for any service interruptions or their consequences.

ARTICLE 3 - User Account

To use the Service, the User must create an account by providing accurate and complete information. Account creation may be done via email/password or through third-party authentication providers (e.g., Google Sign-In).

The User is responsible for maintaining the confidentiality of their login credentials and for any activity that occurs under their account. The User must immediately notify the Provider of any unauthorized use of their account.

The User may request account deletion at any time by contacting: helpuser.spotlight@gmail.com. Account deletion results in the permanent removal of all associated personal data.

The Provider reserves the right to suspend or terminate any account that violates these GTC, after prior notice sent electronically.

ARTICLE 4 - User Obligations

The User agrees to:
• Use the Service in accordance with its intended purpose.
• Not attempt to access restricted areas of the application or its infrastructure.
• Not use the Service for any unlawful or unauthorized purpose.
• Provide accurate information when creating their account.
• Respect applicable laws and regulations.

ARTICLE 5 - Personal Data

The collection and processing of personal data is governed by our Privacy Policy, which forms an integral part of these GTC.

ARTICLE 6 - Liability

The Provider shall not be held liable for:
• Any interruption, malfunction, or unavailability of the Service due to maintenance, technical issues, or force majeure.
• Any loss of data resulting from technical failures or User negligence.
• Any use of the Service that does not comply with these GTC.
• The accuracy of fitness data entered or calculated by the application. The Service is provided for informational purposes only and does not constitute medical or professional fitness advice.

ARTICLE 7 - Intellectual Property

The content of the SPOTLIGHT application is the property of the Provider and its partners and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute a counterfeiting offense.

ARTICLE 8 - Governing Law

These GTC and the operations arising from them are governed by and subject to French law. These GTC are drafted in French. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.

The User is informed that they may in any event resort to conventional mediation, sector-specific mediation bodies, or any alternative dispute resolution method in the event of a dispute.
